If an encroachment (fence line, building or other occupation) has existed for a period of ten years or more, adverse possession may have occurred.  Adverse possession creates a “cloud” on the title of the property that is encroached upon, meaning that ownership of the encroachment area is in question.  If adverse possession has, in fact, occurred, the encroaching party has acquired “color of title,” but not clear title.  Clear title can be obtained by filing suit for “quiet title,” or by entering into a Boundary Line Agreement with the other party.
